Coffee Doktor is a small company and is classed as a sole trader but the company still upholds the highest of standards and expectations when it comes to the environment and equality.
TERMS AND CONDITIONS FOR USING COFFEE DOKTOR SERVICES AND MACHINE PURCHASES.
For a clear intent to inform all customers of Coffee Doktor's Terms and Conditions a link is displayed on all invoices to direct the customers and anyone who uses Coffee Doktor's services to the coffeedoktor.com website where a page is dedicated to the Terms and Conditions.
Surprisingly many Coffee machine or Espresso Machine owners including proprietors of some cafe's and restaurants alike do not know that their espresso or coffee machine is bound by legislation - as an employer/owner/proprietor - you are fully responsible for its safety to protect the public and staff.
Insurance cover for staff and customers may be voided in case of an accident, if the espresso machine or coffee making machine's boiler or any pressurised vessel has not been inspected by a certified professional inspector within the 12 month period required by law and you have received a certificate of such inspection and the result.
TERMS AND CONDITIONS FOR USING COFFEE DOKTORS SERVICES 01/07/2021
1. By using the services of the sole trading company which is named Coffee Doktor you are agreeing to all Coffee Doktor Terms and Conditions of which take precedence over all other terms and conditions.
1.1 The main duty and first priority of a coffee machine repair, maintenance or service by Coffee Doktor is due care and attention including health and safety.
2. It is the responsibility of the customer/proprietor/user/owner of the restaurant, café, shop, office or dwelling or premises using coffee making machinery to be aware of all current legislation regarding coffee machine making equipment and its application/installation and UK Law. Coffee Doktor is not responsible for customers' negligence or lack of knowledge of these regulations, laws or legislation.

3. Coffee Doktor cannot be held responsible for any damage, personal injury or loss of earnings from any new or second hand machine or equipment sold, repaired or maintained by Coffee Doktor under the protection of United Kingdom legislation and law unless in breach of a duty of care which results in damage.

4. PAYMENTS
4.1
Coffee Doktor is providing a service using many years of experience and knowledge of various brands of espresso machines and related equipment.
Coffee Doktor will always endeavour to repair the machine on the first visit or callout to site. Repairing a faulty espresso machine on the first visit or callout is not always possible and parts are often required to be ordered and fit at a later date depending on delivery arrival time and speed unless Coffee Doktor has the parts in stock to fit there and then.
4.2 A callout is when Coffee Doktor has been requested to visit and investigate and if possible repair the faulty espresso machine or related equipment within 1 hour of time from arrival onto the site.
4.2.1 Coffee Doktor will allow 1 hour of repair time included in the callout charge starting at arrival to the site and location of the machine.
4.3 Payment for a callout is due whether the machine is repaired on the callout visit or not. If a second visit is necessary to fit parts to the espresso machine or related equipment the initial callout charge plus added extra time is due for payment as stated in these terms. Once the new parts have arrived Coffee Doktor will fit the parts and test the machine.
4.3.1
The customer will always be notified in a consultation format that any repair to a coffee machine is not guaranteed to repair a faulty espresso machine due to an unidentified fault or if Coffee Doktor can not diagnose the actual error or fault before testing and fitting new parts.
4.3.2
An Espresso machine can be a complex variation of computer programming from a PCB board, when PCB boards become water damaged or over heat, this can mimic errors or faults that are unseen and not possible to test on site and would need to be removed for repair or testing in a workshop. In this case it may be cost effective to replace parts on site that are of less value to test and check errors or faults. In this case the customer will be informed that the charge for repair is still required regardless of whether the machine is repaired and working or functioning adequately.
4.3.3 Coffee Doktor time is always chargeable regardless if the machine is successfully repaired or not.
4.4 A callout charge is required for Coffee Doktor to visit the site and investigate the faulty espresso machine and repair if possible within 1 hour of arrival.
4..4.1
The espresso machine in some circumstances is not repairable, the initial callout charge and any overtime are still due.
4.5 Overtime is charged at an hourly rate if the time limit of 1 hour has passed from the initial arrival to the site to start investigation and repair if possible.
4.6 ALL PAYMENTS FOR A CALLOUT, SERVICE, REPAIR OR INSTALLATION UNLESS OTHERWISE ORGANISED AND STIPULATED ARE DUE ON SITE AND BEFORE COFFEE DOKTOR HAS VACATED.
4.7 IF PAYMENT CANNOT BE MADE ON SITE FOR A VALID REASON THE PAYMENT UNLESS ORGANISED OTHERWISE IS TO BE MADE WITHIN 24 HOURS.
5. Coffee Doktor cannot be held responsible for any damage, personal injury or loss of earnings that arise from lack of awareness or negligence by the owner, proprietor, business owner, manager or supervisor and user of any dwelling or business that has used the services of Coffee Doktor.
6. A coffee machine service, repair or maintenance job on any model, make or brand of espresso or coffee machine by Coffee Doktor is not classified, seen or noted as a safety test or certified inspection in any way be that for insurance purposes or any other reason.

6.1 Any service that Coffee Doktor provides does not include any safety guarantee or certificates of any kind for any purpose including insurance purposes and any such inspection or test should be carried out by a qualified inspector and it your responsibility as a proprietor, business owner, user or customer of Coffee Doktor to adhere to current legal requirements or health and safety legislation and UK Law.
7. Service repair or maintenance work carried out on any espresso/coffee machine or coffee making machine is to be replaced with serviceable parts when needed or required as close to the manufacturer's specifications as possible and in line with UK Law.
8. As stated by the HSE and UK government legislation Coffee Doktor is classified as a competent person having many years and extensive experience working with and repairing a wide range of international branded espresso machines, having been trained by a competent and very experienced coffee machine engineer with extensive electronic and mechanical training.
8. Coffee Doktor is not responsible or entitled to provide a PSSR and coffee machine statutory examination of any machine that is sold, rented, borrowed or leased to a customer of Coffee Doktor regardless of ownership of the coffee/espresso making machinery.
9.1 If you have bought or are renting, borrowing or leasing a coffee making machine that is owned by Coffee Doktor and is installed for constant or permanent use for any period of time the government legislation and UK law states it is the responsibility of the business owner/proprietor or user of the machine or business to meet the requirements of the PSSR and coffee machine statutory examination.
Coffee Doktor agrees with this legislation and law and the terms of use for renting/leasing/borrowing a machine from Coffee Doktor applies in all circumstances over any other.
9.1.1 If the proprietor, cafe owner, business manager, cafe owner, supervisor requires any insurance for the machinery that is used onsite including coffee machines regardless of who owns the machinery it is not Coffee Doktor's responsibility to provide this or any safety certificates that deem the machine safe to use, Any such certification should be provided by a qualified inspector.
9.2 Coffee Doktor is a business that will assist and help in any way we can to help maintain your espresso or coffee machine to the best of our knowledge. If there is anything you are unsure of or require clarifying please contact Coffee Doktor.
9.3 Regardless of ownership of any coffee making machinery it is not the responsibility of Coffee Doktor to inform or make any customer or client of Coffee Doktor aware of UK law, legislation and requirements, including insurance.
10. MACHINE PURCHASES
10.1
Purchasing any machinery from Coffee Doktor including Coffee Machines, Espresso Machines, Coffee Bean Grinders, Water Boilers and all related Equipment.
10.2 If you have purchased or bought a used or second hand machine or any equipment from Coffee Doktor, that purchase or transaction is deemed or classed as sold as seen and in no way is Coffee Doktor responsible for any damage, injury or breakdown of the machine or caused by any fault or manufacturing error of the machine.

10.3 Coffee Doktor does not give any guarantee or warranty on any machinery that is sold other than referring the customer to the manufacturer of such machine.
10.4 If the Coffee/Espresso Machine that is sold to one of Coffee Doktor's customers is classed as second hand or used, Although coffee Doktor tests and inspects each machine before it is sold Coffee Doktor can not be held responsible for any of the possible previous owners negligence or treatment of this or any machine including previous maintenance and repair including damage, or breakdown repair of the machine prior to or after being sold.

10.5 When selling a used or second hand Coffee/Espresso Making Machine to a customer Coffee Doktor will test and inspect the machine with due care and attention but this does not include a guarantee of any kind and the machine is sold as seen.

10.6 When a customer purchases a used or any second hand machinery from Coffee Doktor not including water boilers or Coffee Bean grinders Coffee Doktor will offer 3 months parts only cover if a fault occurs but this does not include the pump motor, the boiler, components directly connected to the boiler such as the heat exchange or boiler gasket bolts and nuts or leaks of any kind from the boiler including corrosion and pitting.

10.7 Coffee Doktor may sell new machinery to its clients, in this circumstance the manufacturer of that or any new machinery sold is the responsibility of the company manufacturer to uphold its manufacturers warranty and guarantee of that specific product. Coffee Doktor will assist in any way it can to help.
10.8 Any warranty or guarantee that a company gives of new machinery sold by Coffee Doktor is the responsibility of that company, manufacturer or brand.
11. SERVICE CONTRACTS
11.1 If you are receiving a service as part of a service contract from Coffee Doktor you will only be covered for labour costs and all parts are NOT covered in any way.

11.2 Any service contract from Coffee Doktor does not include any safety inspections or safety certificates or inspections of the boiler, the boiler gasket, element gasket or any certification of any kind and is solely to be used to reduce callout charges and discounts of services provided by Coffee Doktor.

Any service contract that Coffee Doktor provides does not include any safety guarantee or certificates of any kind for insurance purposes and any such inspection or test should be carried out by a qualified inspector and it your responsibility as a proprietor, business owner, user or customer of Coffee Doktor to adhere to current legal requirements or health and safety legislation and UK Law.
BOILER INSPECTIONS.
PSSR and Coffee Machine Statutory Examinations
A boiler inspection is required by proprietors of a dwelling with a commercial espresso or coffee machine with a pressurised vessel.
If you own a commercial coffee machine that incorporates a steam boiler, it can prove to be a risk that you may want to avoid. This is because you have a statutory obligation to meet the stringent legal requirement of the Pressure Systems Safety Regulations 2000.(PSSR 2000)
The Pressure Systems Safety Regulations 2000 require pressure systems to be examined following a certified Written Scheme of Examination, PSSR aims to prevent serious injury from the hazard of stored energy as a result of the failure of a pressure system or one of its parts.
The Regulations apply to owners, proprietors and users of pressure systems containing ‘relevant fluids’ this includes steam at any pressure of any volume, Coffee Machine steam boilers operate at 100°C and over, therefore they fall within the legal requirements of PSSR 2000.
If you continue to use an espresso machine incorporating a steam boiler without the required boiler inspection services and written Scheme of Examination, you will not be compliant with PSSR 2000.
Commercial coffee machine boilers incorporating a pressure vessel (e.g. espresso machines, coffee machines) that generates steam comes under the requirements of PSSR 2000.
The statutory examination is designed to ensure that the pressure system within your commercial machine is “safe” for continued operation and therefore helps to protect each person who may be in contact with or in the vicinity of that machine.
